La trattazione prende avvio dall’analisi generale delle ragioni che hanno portato il legislatore ad emanare nel nostro ordinamento l’art. 2929 bis c.c. , non fermandosi esclusivamente a quelle rinvenibili dalla relazione illustrativa al d.l. 27 Giugno 2015 n. 83 ossia un beneficio per il ceto creditorio e per l’amministrazione della giustizia, ma cercando di comprendere attraverso l’analisi del tessuto normativo in cui l’art. de qua è destinato ad inerirsi , la reale voluntas legis.
