Abstract/Index

The American and the Italian constitutional framework of borrowing and budget formation power. An initial reflection about Jefferson’s letter to Madison: public debt as a burden on future generations. The American constitutional discipline of borrowing and budget formation power: “borrowing power” in the American Constitution and debt ceiling. The Italian constitutional discipline of “borrowing” and budget formation power. Public debt in Italy and in the US: a brief illustration of the evolution in relation to the legal framework. Public debt and budget in Italy: the evolution of debt in time from law no. 62/1964 to the present by way of law no. 362/1988. Public debt and budget in the US: the evolution of debt in time from congressional budget and impoundment control act of 1974 to Trump adm. Conclusions: debt, separation of powers and democracy: a comparison between a presidential and a parliamentary system. Public debt and democracy: public debt as linked to the thrive for democratic consensus or as a threat to democracy? Separation of powers and borrowing power: the role of the executive and of the legislative.
