The internationally wrongful acts: the relevant international obligations violated by the Russian Federation through its war of aggression in Ukraine. treaty-based obligations. Customary law obligations. Peremptory norms recognized by civilized nations (jus cogens). The issue of attribution: are the acts and conducts at stake attributable or imputable to the Russian Federation? Explaining attribution as a prerequisite of State responsibility. Conducts performed by State-actors (Russian government officials and regular armed forces). Activities performed by non-State actors. The modes of attribution of such conducts to the wrongdoing State. Circumstances precluding wrongfulness. Consent. Self-defense: the never-ending alibi of self-defense. Countermeasures. Necessity: the alleged need of protecting the vital interest of the Russian Federation by means of the war. The responsibility dimension. The consequences of responsibility under the ILC’s articles on State responsibility for internationally wrongful acts). The guarantees of non-repetition.
