Understanding content moderation. Definition and purpose of content moderation on digital platforms. Types of content moderation practices, the role of technology in shaping moderation practices (AI) and its shortcomings. Human rights framework. The relevance of regulatory frameworks. European legal framework for content moderation. Human rights-based approach to content moderation: opportunities and challenges. International human rights standards applicable to content moderation practices (freedom of expression standards ex art. 19 ICCPR). Human rights responsibilities of social media companies. United Nations guiding principles on businesses and human rights: implementing the UN “protect, respect and remedy” framework. Challenges of platform regulation and enforcement: intermediary liability. Telegram case: a dangerous precedent or the rise of a new standard for content moderation? The relevance of this case and emerging concerns. Encryption, anonymity and moderation: a delicate balance (“hands off” moderation vs “active” moderation).
