Theoretical framework: populism and the separation of powers. Definition of populism’s modern conception and its relations with the judiciary. Separation of powers and judicial independence in executive-judicial relations. Relationships between powers of the state in the Italian constitutional framework: the 1948 constitution. The “tangentopoli” scandal and the end of the “Repubblica dei partiti”. The origins of the crisis. The unfolding of the corruption scandal and the decline of traditional parties. The judiciary’s role within popular support and power struggles. The rise of populist forces and the clashes between executive and judiciary. A new political system: transition, bipolarism and the emergence of populism. The Italian case: “Berlusconism” and the judiciary.
