The connection between mass atrocities and cultural heritage. The problem. Defining cultural heritage. Destruction of cultural heritage: why does it occur? Destruction of cultural property as a crime under international law. Two qualifications: war crime and crime against humanity. Destruction of cultural heritage as evidence of intent to commit genocide. Prohibition of deliberate destruction of cultural heritage in peacetime. Individual criminal responsibility for deliberate destruction of cultural heritage. Prosecution of individuals under international criminal law. The ICC judgment in the Al Mahdi case. Cultural crimes entailing state responsibility. CJ and genocide cases: Bosnia and Herzegovina v. Serbia and Montenegro, Croatia v. Serbia.
