The foundations of data protection in EU primary law. The basic notion of data retention in the context of data protection. The international framework previous to the EU legislation: how data protection became a fundamental right independent from the right to privacy. The beginning of data protection in the EU: the data protection directive. The scope of application of article 16 TFEU. The mandate upon the European Union to legislatively ensure the protection of personal data. The EU framework concerning data protection: an analysis of the main secundary law sources. Analysis of the directive’s most relevant provisions: art. 5: the principle of confidentiality. The European Union framework on data retention: the birth and life of the data retention directive. Privacy rights and State interest in crime repression: the evolution of the relevant CJEU case law from digital rights Ireland to the H.K v Prokuratuur decision. The issues relating to the generalized and indiscriminate retention of data. Prohibition of general and indiscriminate retention of data: the CJEU’s findings in Tele2. Legal rules and agreements that can be referred to in order to give a definition of what constitutes a serious crime.
