The protection of religious freedom in Europe: a theoretical framework. Why is religious freedom important? The protection of fundamental rights in Europe. The right to religious freedom in ECHR. The intersection of article 9 with other convention rights. The subsidiarity principle and the margin of appreciation doctrine. Structure and legal framework of article 9 ECHR: belief and manifestation. Defining religion or belief. The legal dimension of article 9: Forum internum and Forum externum. Requirements for the restriction of the forum externum. The limitation clause as a tool for protection. How interferences with the right to manifest religious freedom are justified by the ECHR: the case of the Islamic veil ban. Article 9 ECHR and the Islamic veil. The theological and cultural meaning of the Islamic veil. The principle of neutrality and secularity of the State and the veil ban. Additional grounds of justification for interferences with the freedom to wear the Islamic veil. The Court's restrictive approach to the Islamic veil.
