The Court of arbitration for sport (CAS): institution, procedure and review. Origins, legal basis and institutional structure. Jurisdiction and admissibility. Conduct of proceedings. Scope of review in appeal proceedings. Provisional measures in the pre-season context. Article 5 UEFA: text, purpose, and the “consistency problem”. Purpose and normative architecture of article 5 (integrity of competition). “control” and “significant influence”. Decision-making within UEFA under article 5. Why inconsistency arises in practice. Article 5 in practice: before/after the assessment-date shift and review before the Court of arbitration for sport. Post-shift cases (march benchmark): strict outcomes and CAS review. Pre-shift cases (june benchmark): conditional compliance without CAS escalation. Comparative discussion: what changes after the assessment-date shift. The role and limits of CAS in addressing inconsistency under article 5. Should CAS be inconsistent correctly, or should UEFA act internally? Focused proposals.
